Eviction Laws in San Jose

If you are facing eviction in San Jose, here are some laws you should be aware of.

Key Protections for Tenants
  • The Tenant Protection & Rent Stabilization ordinances protect tenants in San Jose by ensuring that landlords are required to provide “just cause” and notice before evicting a tenant if the eviction is an “at-fault” eviction.
  • After serving an eviction notice, the landlord must submit a copy of the eviction notice to the City’s Rent Stabilization Program. If the landlord doesn’t comply, the tenant can take legal action.
  • These include nonpayment of rent, material lease violation, and criminal activity.
  • In case of “no-fault” evictions, the landlord can evict a tenant for substantial rehabilitation, owner move-in, or legal order to vacate.
  • If the unit is covered under the city’s ordinances, a landlord may owe relocation assistance when evicting under a no-fault cause.
Apartment Rent Ordinance (ARO)
  • Units in buildings with three or more dwelling units that were built before September 7, 1979, are subject to rent stabilization. Landlords may only increase the rent once every 12 months, and the increase is capped at 5% of the current gross rental rate.
  • Exemptions to these protections include single-family homes, condos, and new buildings, among other specified categories.
Discrimination
  • The Renting Has Its Rights program prohibits discrimination against renters who hold housing vouchers (such as those under Section 8) when applying for rental housing.
  • Tenants are protected against landlord retaliation (for example, increasing rent, reducing services, or threatening legal action). If the landlord violates the Tenant Protection Ordinance’s “just cause” protections, tenants may be entitled to double or triple actual damages.
