Eviction Laws & Tenant Protections in San Rafael

If you are a tenant renting in San Rafael, here are some legal protections and local ordinances you should be aware of. These laws protect you from unfair treatment by your landlord.

1. Just Cause for Eviction
  • Under the Cause for Eviction ordinance (effective July 17, 2019), landlords renting out properties with three or more units must provide a valid reason (also known as cause, tenant-fault, or “no-fault”) to terminate a tenancy.
  • At-fault reasons can include non-payment of rent, lease violations, or violent/criminal activity.
  • No-fault reasons can include the landlord’s own move-in, unit withdrawal from the rental market, or substantial rehabilitation for health and safety.
  • If the tenant receives an eviction notice, they should check if it states a just-cause reason under the local ordinance.
  • Tenants do not have to accept a notice to vacate without cause or removal of utilities without a court order. These are considered unlawful self-help measures.
  • The ordinance applies to most multi-unit properties (3+ units) but excludes certain owner-occupied units, government-subsized units, and affordable housing developments.
